These Terms of Service ("Terms") govern your use of the nexweb.au website and the services provided by NEX WEB Digital ("NEX WEB", "we", "us", "our"). By using our Website or engaging our services, you agree to these Terms.
NEX WEB provides website design, development, hosting, and ongoing management services, including but not limited to website design, logo and full branding, SEO optimisation, social media management, hosting, custom domains, and custom email setup, as described on our Website or in your individual quote or agreement.
Pricing shown on our Website is indicative and subject to change. A formal quote will be provided before work begins. Some packages include an upfront first-month fee followed by a recurring monthly subscription, as described at the time of purchase.
Fees are payable as set out in your quote or invoice. Continued access to hosting and ongoing services is dependent on payments being kept up to date. We reserve the right to suspend services, including unpublishing a website, if payment is not received.
You agree to provide accurate information, timely feedback, and any content, assets, or access (e.g. domain login details) reasonably required for us to deliver the agreed services.
Upon full payment, you will own the final website design created specifically for you, excluding any third-party assets, stock content, licensed software, or the underlying platform or tools used to build and host it. NEX WEB retains the right to showcase completed projects in our portfolio and marketing materials unless otherwise agreed in writing.
You may cancel ongoing monthly services at any time by notifying us in writing. Cancellation will take effect at the end of the current billing period. Fees already paid are non-refundable unless otherwise required by law.
While we aim to deliver high-quality, effective websites, we do not guarantee specific business outcomes, search engine rankings, or advertising results, as these depend on factors outside our control.
To the maximum extent permitted by law, NEX WEB's liability for any claim arising from our services is limited to the amount paid by you for the relevant services. We are not liable for indirect, incidental, or consequential loss.
These Terms are governed by the laws of Australia. Any disputes will be subject to the exclusive jurisdiction of the Australian courts.
We may update these Terms from time to time. Continued use of our Website or services after changes are posted constitutes acceptance of the updated Terms.
